In plain language: if your primary dwelling was substantially damaged or destroyed in a state emergency and your property is located in a qualifying county (including Los Angeles and Ventura), a local agency must now issue a Certificate of Occupancy for a detached Accessory Dwelling Unit (ADU) before the primary dwelling is complete.
The only caveat is that the ADU must pass all required safety and building inspections. This means fire victims can legally move into a newly built ADU on their own lot while their main house is still under construction or in the permitting phase.
For homeowners who have been paying rent or living in temporary housing since the January 2025 fires, this legislation is a practical lifeline. It allows families to return to their own property and community much faster.

The basic eligibility requirement is that the property must have had a primary dwelling that was damaged or destroyed in a declared state emergency. However, properties located within the Coastal Zone (which includes much of Malibu and Pacific Palisades) have additional requirements and are subject to a separate coastal review pathway.
